Welcome to SokoSauti. These Terms of Service ("Terms") are a binding agreement between you and SokoSauti (the legal entity providing the Service, referred to as "SokoSauti," "we," "our," or "us"), and govern your access to and use of our AI-powered marketing platform, including our websites at sokosauti.com and sokosauti.lovable.app and all related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and SokoSauti.

The SokoSauti name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of SokoSauti or its affiliates. You must not use such marks without the prior written permission of SokoSauti. All other names, logos, product and service names, designs, and slogans on this Service are the trademarks of their respective owners.

2.3 Restrictions on Use

You agree not to:

• Copy, modify, or distribute the Service or any content without written permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Remove any copyright, trademark, or other proprietary notices
• Use our trademarks, logos, or brand assets without explicit authorization
• Create derivative works based on our proprietary technology or content
• Reproduce, duplicate, or exploit any portion of the Service for commercial purposes without express written consent

3. User Content and Data

• Contains malicious code, viruses, or harmful components
• Is unlawful, defamatory, obscene, or otherwise objectionable
• Violates the privacy or data protection rights of others

• Create a strong, unique password for your account

• Keep your account information accurate and up-to-date

SokoSauti employs industry-standard security measures including encryption and secure authentication to protect your account. However, no method of transmission over the Internet is 100% secure.

5. AI-Generated Content

Our Service uses artificial intelligence to generate marketing content, including but not limited to ad copy, images, and marketing strategies. You acknowledge that:

• AI-generated content is provided "as-is" and may require human review and editing
• You are responsible for reviewing and approving all AI-generated content before use
• SokoSauti does not guarantee that AI-generated content will be free from errors or suitable for your specific needs
• You grant SokoSauti the right to use anonymized data to improve our AI models

6. Payment and Subscription

Certain features of the Service require payment of fees. By subscribing to a paid plan, you agree to pay all applicable fees as described in our pricing page, including any applicable taxes. Subscriptions renew automatically at the end of each billing period until cancelled.

Payments are processed securely by our payment partners, including Paystack and M-Pesa. Refund requests can be submitted by contacting our support team. Our refund terms are described in our Refund Policy, which offers a 30-day money-back guarantee.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SOKOSAUTI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us at wambani@sokosauti.com. Upon termination, we will retain your data for a reasonable period to comply with legal obligations, but you may request deletion of your personal data in accordance with our Privacy Policy.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in Nairobi, Kenya, unless otherwise required by applicable law.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
